In order to silence any resistance to our latest dictatorship, our president called for a vote to close the owners forum. The result wouldn?t matter, that she would only find a minority of 11 votes (committee, friends?)To have it shut, as she?d created in the wording of the vote the excuse she would use to close it anyway, putting her own wishes before the owners who are the governing body of the resort, she shut it down.

Making another pretence at complying with community law, it was made clear that our presidents wish to change the statutes with regard to painting would require a unanimous agreement. Unable to comprehend that other owners might not have a problem with the statutes she threw her toys out of the pram when 73 owners, 11 communities voted against the change.
Moving on to the resort AGM where the wishes of owners can be ignored and knowing that our eager to please community presidents are always impressed by the presence of a lawyer they wheeled one in, but not to tell them the law, that would give the game away. Instead a raft of rhetoric that includes the usual attacks against Polaris and constant referrals to experts in the field, painting technicians (builders who get their expertise from reading what it says on the tin) convincing those present that the owners who voted against the change of statutes are the devils spawn and were only doing it out of spite.
After the usual hats tossed in the air followed by a chorus of for he?s a jolly good fellow waking up the back row who?d only turned up for tea and biscuits they vote to give the 73 owners 3 months in which to change their vote (water boarding?) or face the possibility of being dragged to court charged with abuse of rights!! (Nope! Me neither) These same threats aimed at owners who voted against the installation of paddle courts.

Welcome to North Korea! They?ve upped their game, we should now all fear the consequences of how we vote.

All of that is wrong on any level, but the biggest danger may come from them having welcomed onto the committee a villa owner known for being responsible for the fee calculations illegally being altered to his own benefit.
Can?t wait to see his plans for the future!

If they do not obey the law they can be sued by any owner or a Denuncia to the Guardia Civil. As a committee in that situation they would surely lose and be fined at least. Depends whether anyone will stand up to them. They cannot just change or ignore the statutes and the administrator should be liable too if they condone this. BTW I do not live on La Torre.

Its not the system thats the problem, its the owners who get themselves elected only to manipulate it.
They had no idea what they were signing up for, they dont respect Spanish community law, the statutes or the contracts they blindly signed, they bleed out misleading information in order to trick owners into believing the changes they make are correct when theyre only done in order to suit their own requirements.

Often politely referred to as the its not fair brigade, my own opinion for what its worth, bunch of crooks.

The statutes can without doubt ONLY be changed by a unanimous vote by all owners. So any attempt to do this at an AGM could easily be challenged by a lawyer.

A simpler way might be to have one proxy vote (need not be at the meeting) which clearly votes against. This needs to be validated by the administrators but they should keep it confidential. If they dont they could be in contravention of Spanish data protection laws.
